Terms of Service

These Terms govern the HiTutor mobile app, website, and related features (collectively, the “Service”). By using the Service or creating an account, you agree to these Terms and the Privacy Policy.

Nothing in these Terms limits mandatory rights granted by the law where you live.

1. The Service and operator

HiTutor is an AI language-learning service providing real-time voice conversation, transcription, feedback, review, learning plans, and progress estimates. “HiTutor,” “we,” “us,” and “our” mean the operator of the Service; “you” means an individual using it.

2. Eligibility and minors

You must be able to enter a valid contract where you live or have permission from a parent or legal guardian. The Service is not directed to children under 13. If a higher digital-consent age applies in your jurisdiction, users below that age need valid guardian consent.

3. Accounts and security

Provide accurate information and use your individual account yourself. Keep access to supported login providers and devices secure and notify us promptly of suspected unauthorized use. You may not sell, rent, transfer, or use another person’s account.

4. Nature of the AI learning service

HiTutor responses, transcripts, translations, corrections, levels, and CEFR estimates are AI-generated or AI-assisted learning information. They may be inaccurate, incomplete, inappropriate, or different from natural human usage, and are not official test results or professional qualifications.

Do not rely on the Service for medical, legal, financial, safety, or emergency advice. Verify important decisions with qualified professionals or authoritative sources.

5. Acceptable use

Use the Service for personal language learning and only as permitted by law. You must not:

  • Submit, generate, or share illegal, fraudulent, threatening, harassing, hateful, sexually exploitative, or rights-infringing material.
  • Provide another person’s personal, confidential, or voice data without lawful authority.
  • Bypass or disrupt account, usage, payment, security, or safety controls.
  • Distribute malware, make excessive automated requests, scrape the Service, or impair its stability.
  • Copy, reverse engineer, resell, or use the Service or models to build a competing service beyond what applicable law allows.
  • Impersonate others or represent AI output as officially verified by a person.

6. Your content and voice

You retain rights in what you say or submit. You grant HiTutor a worldwide, non-exclusive, limited license to host, transmit, process, and transform that content only as needed to operate conversations, create feedback and review, maintain security, and resolve failures. This license is limited to providing the Service and follows the retention rules in the Privacy Policy.

You must have the necessary rights to your content and should avoid including unnecessary sensitive data or another person’s confidential information in a conversation.

7. Free use, usage limits, and operational adjustments

Free time, features, conversation duration, and usage limits may be shown in the Service or a separate policy. To prevent abuse, compensate for incidents, support users, or enforce policy, we may reasonably grant, revoke, or adjust available time and may record or notify you of a material adjustment.

8. Paid subscriptions, billing, and refunds

Paid features may be offered through the Apple App Store, Google Play, or another external store. Price, taxes, billing period, trial, auto-renewal, and cancellation terms are shown at purchase and governed by the store. Your subscription may renew unless canceled before renewal.

Manage subscriptions and request refunds through the store that processed payment unless applicable law requires otherwise. These Terms do not limit mandatory cancellation, refund, or consumer rights. We may withhold or revoke paid access after failed verification, refunds, chargebacks, or confirmed fraud.

9. HiTutor intellectual property

The Service software, design, brand, orb, documentation, curated content, and operational technology belong to HiTutor or their rightful owners. These Terms grant only a limited, revocable, personal right to use the Service. All ungranted rights are reserved, and HiTutor names and marks may not be used commercially without permission.

10. Third-party services

HiTutor may use statistics services such as Google Analytics to understand and improve its own websites and apps. The Privacy Policy and relevant website or app notices explain scope, cookies and analytics identifiers, collected information and your rights. Acceptance of these Terms does not replace any separate data-processing consent required by applicable law.

The Service may rely on or link to third-party AI, authentication, cloud, notification, app-store, and payment services. Their terms and privacy policies may apply. We select providers with reasonable care but do not control or guarantee the continued availability of their services.

11. Changes and availability

We may add, modify, or discontinue features for quality, security, legal, technical, or business reasons. Maintenance, networks, providers, or events beyond reasonable control may interrupt the Service. For a materially adverse change to a paid service, we will provide reasonable notice and remedies required by applicable law.

12. Restrictions and termination

You may stop using the Service and delete your account through the available app process. We may limit, suspend, or terminate content, features, or account access where reasonably necessary for a Terms violation, security risk, fraud, unlawful activity, payment issue, or risk of harm.

Where circumstances permit, we will explain the action and available appeal route. Payment obligations, intellectual-property terms, liability limits, and dispute provisions that by nature should survive will continue after termination.

13. Disclaimer of warranties

To the extent permitted by law, the Service is provided “as is” and “as available.” We do not promise uninterrupted or error-free operation, accurate AI output, or a particular learning result. We will provide the Service with reasonable care and skill, and mandatory statutory warranties and consumer rights remain unaffected.

14. Limitation of liability

To the extent permitted by law, HiTutor is not liable for unforeseeable or indirect loss or loss of data, opportunity, or profit. This does not limit liability for fraud, willful misconduct, gross negligence, death or personal injury, or any liability that law does not allow us to exclude. For paid services, total liability will ordinarily not exceed what you paid HiTutor during the 12 months before the event giving rise to the claim, unless mandatory law requires otherwise.

15. Governing law and disputes

Please contact us first so we can try to resolve a dispute. To the extent permitted by law, these Terms are governed by the law of the country where the HiTutor operator is established, and disputes are heard by its competent courts. Mandatory consumer protections and courts or dispute-resolution channels available where you live remain unaffected.

16. Changes and general terms

We may update these Terms to reflect Service or legal changes. We will give reasonable advance notice of material changes and request consent where required. Continuing to use the Service after the effective date constitutes acceptance to the extent permitted by law.

If one provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer rights under these Terms without our prior written consent.
